Tourism Kamloops – A Friends Golf & Spa Getaway Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The following promotion is intended for play in Canada only and will be construed according to Canadian law. Please do not enter if you are not located in Canada.

1. HOW TO ENTER
NO PURCHASE NECESSARY. Promotion begins June 16, 2008 and ends June 27, 2008. To participate, contestants can receive one entry by visiting www.tourismkamloops.com prior to 11:59 p.m. Pacific Time June 27, 2008 and completing the Friends Golf & Spa Getaway entry form, then pressing “Submit”. To enter without internet access, contestants can hand-print their full name, mailing address, daytime phone number and the date of entry on an 8” by 5½” plain piece of paper, sign the paper and mail it to: Tourism Kamloops, 1290 West Trans Canada Highway, Kamloops, B.C, V2C 6R3. Mail-in entries must be postmarked by June 22, 2008 and June 27, 2008. Entries become the property of Tourism Kamloops (“Sponsor”) and will not be returned.

Limit one entry per person regardless of method of entry.

2. ELIGIBILITY
Entrants must be legal Canadian residents (including residents of Quebec) who are over the age of majority in their province as of June 30, 2008. Employees of Sponsor, its affiliates, marketing partners, suppliers, advertising or promotional agencies, and the immediate family members (mother, father, brother, sister, son, daughter, spouse) of, or persons residing in the same household as, such persons, are not eligible. All federal, provincial and local laws and regulations apply. Participation in this Getaway constitutes contestant’s full and unconditional agreement to and acceptance of these Official Getaway Rules. Participants who do not comply with these rules are subject to disqualification.

3. PRIZE
There is one Kamloops Golf & Spa Adventure Getaway package available to be won as the Grand Prize. The prize consists of three (3) nights accommodation at the South Thompson Inn & Guest Ranch, a $100 gift certificate to Forster’s Primerib & Steakhouse, 18 holes of golf for four (4) at Canoe Creek Golf Course including cart, 18 holes of golf for four (4) at Talking Rock Golf Course including cart, 18 holes of golf for four (4) at Tobiano Golf Course, a $100 gift certificate to The Brownstone Restaurant, a $100 gift certificate to Chapter’s Viewpoint Restaurant, and a 1.5 hour massage for four (4) courtesy of Sunmore Ginseng Spa. Elements of prize packages may be substituted or altered in whole or in part for equal or greater value in the sole direction of the Sponsor. The retail value of the prize is approximately $2,185.00. Taxes, if any, related to the prize are the responsibility of the individual winner. All other costs and expenses associated with the Grand Prize, including without limitation transportation to and from the airport in the winner’s city or area of residence, all ground transportation in British Columbia including ground transportation to and from the departure airport and the accommodations, incidental hotel expenses, additional accommodation required, meals, gratuities, insurance, taxes, lift tickets, ski rentals, and items of personal nature are the responsibility of the winner and his or her guests. The Grand Prize is subject to space availability at time of booking. Winner and guests must travel together and guests must be at the age of majority in the province in which they reside, except where the winner is the legal parent or guardian of the guest(s). Travel must be completed by October 30, 2008 and black-out dates and restrictions apply. If the winner and guests cannot complete travel by date specified, the Grand Prize will be forfeited in its entirety. The above prize descriptions constitute the expected components of the Grand Prize; all aspects thereof are subject to availability and subject to change. Certain activities or properties may not be available at the time of travel and Sponsor reserves right to make substitutions of prize elements in its sole discretion. Some additional restrictions may apply. Winner will be provided with additional details at or before time of travel.

4. SELECTION OF WINNERS
On or about June 30, 2008, a random draw will be conducted by the Sponsor or its designee, the judges of the Getaway, to select one (1) entry from all eligible entries received. The Sponsor or its representatives will attempt to contact the selected entrant by phone once per day for five (5) business days. If any selected entrant cannot be contacted after five (5) business days, or is contacted but is deemed to be ineligible in the Sponsor’s sole discretion, or unable or unwilling to comply with the rules, that selected entrant will be disqualified and another name will be drawn. This process may be repeated until one (1) entrant has been declared a winner. Odds of winning are dependent upon the total number of eligible entries received.

Before being declared a winner, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question to be administered by telephone at the time mutually convenient for the entrant and Sponsor or promotional agent of Sponsor.

5. NAME OF PRIZE WINNER
For the name of the prize winner, send a self-addressed stamped envelope with this request in writing to: Tourism Kamloops, 1290 West Trans Canada Highway, Kamloops, B.C, V2C 6R3.

6. RELEASE
By pressing “Submit” on the electronic form, you are confirming compliance with Getaway Rules and acceptance of prizes as offered; releasing Sponsor, its agents, and the prize suppliers in respect to injuries, accident, loss or misfortune relating to the Getaway or the awarding or use of the prize; and, except where prohibited, acknowledging the Sponsor’s and its agents’, subsidiaries’ or affiliates’ right to publish or broadcast the winner’s picture, name, address, voices, statements without further compensation other than the prize offered. By entering the contest the Winner and traveling companions automatically agree to release all liability and publicity to Tourism British Columbia and Tourism Kamloops prior to travel. In addition, the winner and their guest(s) must each complete, sign and return a Tourism Kamloops waiver prior to receiving their prize package.

7. ERRORS, ETC.:
The Sponsor is not responsible for (i) entries which are lost, late, incomplete, postage due, illegible, damaged, destroyed or misdirected; (ii) telephone, technical, network, online, electronic, computer hardware or software failures of any kind; (iii) incomplete, garbled or delayed Internet/e-mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof; (iv) any condition caused by events beyond its control which disrupts or interferes with the Getaway; or (v) any injury, loss or damage of any kind arising out of participant’s participation in the Getaway or the acceptance, possession or use of the prize, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation or downloading any materials in this Getaway.

The Sponsor extends absolutely no representations or warranties in respect of the prize. If for any reason the Getaway is not capable of running as planned or if the administration, security, fairness, integrity, or proper conduct of the Getaway is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond its control, the Sponsor reserves the right to cancel, terminate, modify or suspend the electronic portion of the Getaway, including any method of entry, and randomly select the winner from previously received entries.

The Sponsor reserves the right to amend the terms of this Getaway without prior notice if any factor interferes with its proper conduct as contemplated by these Rules.

8. MISCELLANEOUS:
Prize is not transferable and must be accepted as awarded with no substitutions, whether in cash or otherwise, except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize of equivalent or greater value if a prize cannot be awarded as described for any reason. Prize will only be awarded to verified winner. All decisions of the Sponsor or their authorized representatives are final and binding in all matters relating to this Getaway. In the event of a dispute regarding the identity of the person submitting an electronic entry, the entry will be deemed to be submitted by the person whose name is supplied on the contest form at tourismkamloops.com.
